% 30.08.2016 Crl.M.A. 13396/2016 Exemption allowed subject to just exceptions. BAIL APPLN. 1772/2016 Notice. Learned APP for the State accepts notice. By the present petition the petitioner seeks anticipatory bail in case FIR No.666/2016 under Sections 377/354A IPC registered at PS New Usmanpur on the complaint of the wife of the petitioner. In the FIR the complainant alleged that the marriage between the parties was solemnized on 18th August, 2014 as per Muslim Rites and that after the marriage the petitioner forcibly performed unnatural sex and BAIL APPLN. 1772/2016
showed blue films. On these two allegations the above-noted FIR was registered.
The complainant has been medically examined. Nothing is required to be recovered from the petitioner. Till date no notice has been issued to the petitioner for joining the investigation. Considering the fact that custodial interrogation of the petitioner is not required, I deem it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will not join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned.
Petition is disposed of. Order dasti.
