O R D E R

% 12.07.2017 The petitioner seeks bail in anticipation of his arrest in connection with FIR No.154/2017 dated 27.03.2017 (P.S. Nihal Vihar) instituted for offences under Sections 308 and 34 of the IPC. The allegation in the FIR is that when the brother of the informant was being assaulted, the informant went to his rescue and he too was thereafter assaulted by one of the accused persons, leading to minor injuries on his person. Out of the two accused persons, who had gathered near the house of the informant, one fled away after the occurrence who is stated to be the petitioner. Learned counsel for the petitioner has drawn the attention of this court to the status report which indicates that the co-accused Amarjit @ Sonu was also injured in occurrence and a separate case vide FIR No.338/2017 was instituted for offences under Sections 325/34 IPC at the instance of Amarjit @ Sonu.

The status report further reveals that after the petitioner was granted interim protection, he participated in the investigation. Taking into account the aforesaid facts as also that the injury suffered by the informant has been opined to be simple in nature, this court is inclined to grant anticipatory bail to the petitioner. In the event of his arrest or surrender, the petitioner shall be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the arresting officer. Needless to state that the petitioner shall keep participating in the investigation.

The bail application stands disposed of.
