% 10.03.2016 The present petition has been filed seeking quashing of FIR No.170/2013 dated 25.09.2013 registered at CAW Nanakpura, Delhi under Sections 498A/406/34 IPC.
During the pendency of the petition vide order dated 29.01.2015 it was directed that upon the petitioner depositing the settled amount of Rs. 23,50,000/- with the Registrar General of this court within four weeks from today, the proceedings before the Trial Court shall remain stayed.
In compliance thereof, the petitioner deposited the said amount
with the Registrar General on 19.02.2015.
It has been submitted by the learned counsel for the parties that the parties have entered into settlement and by virtue of the same, the petition may be dismissed as withdrawn and the Crl.M.A.No.3245/2016 may be allowed.
In the given facts and circumstances, Crl.M.A.No.3245/2016 is allowed and the Registrar General is directed to release the aforesaid amount along with interest accrued thereon in favour of the petitioner. The learned counsel for the petitioner, as prayed for, is granted liberty to move the court for quashing of the FIR in question if need be.
The petition is accordingly dismissed as withdrawn with liberty as prayed for.
