% 26.04.2017 Issue show cause notice to respondent no.1. Learned counsel for the respondent no.1 accepts notice. In fact, at present, the relief is prayed only against the respondent no.1 as even the allotment letter has not been issued. Therefore, notice need not be issued to the respondent no. 2. Learned counsel for the petitioner submits that petitioner's 1/12th share in the total land admeasuring 37 Bighas and 17 Biswas falling part of Khasra Nos. 44/23(4-9), 57/4 (4-5), 6(5-4), 7/2(3-7), 14/1 (3-16), 15(4-16), 16(4-16), 18(4-16), 19/2 (2-8) in the revenue estate of village Narela was acquired vide Award No. 24/2003-04 dated 29th January, 2004. Petitioner applied for the allotment of an alternative plot in lieu of his acquired land vide application dated 24th January, 2005 and submitted all the relevant
documents. Petitioner's case was considered by the Recommendation Committee on 7th August, 2015. Discrepancy regarding name of petitioner's father was pointed out which was clarified by filing an affidavit. Vide letter dated 15th September, 2015 petitioner was asked to submit certain additional documents which were duly furnished by him, however, no decision has been taken by the respondent no.1 till date.
Writ petition is disposed of with the direction to the respondent no.1 to dispose of the application of the petitioner for allotment of an alternative plot expeditiously, as per the seniority list. However, it is made clear that in case, any other document or information is required from the petitioner, the same may be obtained from him within four weeks from today. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
