W.P.(C) 7682/2016 & & CM No. 31648/2016 (stay) The petitioner impugns the show cause notice dated 11.08.2016 issued by respondent no. 1 proposing to, inter-alia, ban/debar the petitioner from any future dealing either in its own name or in any other name with the Directorate General of Hydrocarbons for a period of 10 years from the date of issuance of the order. Learned Senior Counsel for the petitioner submits that the petitioner has impugned the action of the respondent in terminating the Agreements dated 21.12.2005 and 25.09.2008 and has filed a W.P.(C) 7682/2016

petition under Section 9 of the Arbitration & Conciliation Act, 1996. Learned counsel for the respondents submits that the respondent authority have only issued a show cause notice at this stage and are yet to adjudicate upon the same. In view of the above, the writ petition is disposed of directing the respondent authority to adjudicate upon the show cause notice and pass appropriate order thereon.

However, in case any order is passed on the show cause notice against the petitioner, the said order would not be implemented for a period of 10 days from the date of passing and communication to the petitioner.

This order is without prejudice to the rights and contentions of the parties.

The writ petition is accordingly disposed of. Dasti under signatures of Court Master.
