O R D E R

% 29.04.2015 Petitioner is facing sentence of five years under Section 304 (II) of the IPC.

He has already undergone about two years.

His appeal has been dismissed on 27th November, 2014. Petitioner seeks parole in order to file Special Leave Petition in the Supreme Court.

Government of N.C.T. of Delhi has dismissed the application of petitioner for grant of parole on the ground that there is possibility of petitioner jumping the parole as also in view of the fact that petitioner was re-admitted in jail only on 7th June, 2014 and has not completed one year.

Limitation for filing the Special Leave Petition is 90 days. Release of a convict on parole on the ground of filing

Special Leave Petition is envisaged in para 9.7 of the Parole/Furlough Guidelines, 2010.

Accordingly, para 11.1 is in conflict with para 9.7 of Parole/Furlough Guidelines, 2010, which envisages release of a convict on parole to enable him to file Special Leave Petition. Keeping in mind the totality of circumstances, petitioner is directed to be released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of Jail Superintendent. During the parole period, petitioner shall report to the Station House Officer, P.S. Geeta Colony once a week, i.e., on Mondays at 10:00 am. Petitioner is also directed not to leave the territorial bounds of Delhi. On completion of parole period, petitioner shall surrender before the Superintendent Jail. Writ petition is disposed of in the above terms. Copy of the order be sent to the Jail Superintendent for serving it upon the petitioner and for compliance.
