Considering that the arbitration proceedings have already commenced, the statement made by learned counsel for the Petitioner on 29th August 2016 is directed to continue till such time an order is passed by the learned Arbitrator in an application under Section 17 of the Arbitration and Conciliation Act, 1996 in accordance with law.

2. It is further clarified that this order is without prejudice to the rights and contentions of Respondent No. 3 in the arbitral proceedings between Respondent No. 3 and the Petitioner.
