% 01.09.2016 Crl.M.A. 13526/2016 (Exemption) Application is allowed subject to just exceptions. Crl.M.C. 3157/2016 & Crl.M.A. 13527/2016 (Stay) Counsel for the petitioner has filed the present petition against the order dated 23.08.2016 vide which the Trial Court had issued the Non Bailable Warrant against the accused/petitioner. Perusal of order shows that previously a cost of Rs.25,000/- was imposed upon the petitioner in terms of Sessions Court and subsequently Non Bailable Warrants were received back unexecuted with the report "Not Found/ Left Address".
On that day, an application was again moved for exemption on behalf of the accused and it was observed that the said application was filed just for the purpose of delaying the proceedings and the exemption application was dismissed with cost of Rs.10,000. Fresh Non Bailable Warrants were issued against the accused/
petitioner for 23.09.2016.
The background mentioned in the order shows that the petitioner has been avoiding the appearance and delaying the proceedings. In such a scenario, this Court does not find any ground to exercise the jurisdiction under Section 482 Cr.P.C. The petition is accordingly dismissed.
