% 10.04.2017 CM APPLs. 12983-12984/2017 Keeping in view the averments in the applications, the delay in refiling the reply-affidavits is condoned. Accordingly, the applications stand disposed of. CONT.CAS(C) 995/2016 On 23rd August, 2016, a Coordinate Bench of this Court had directed suo moto registration of present contempt petition against Mr. Bhanwar Singh and Mr. Sher Singh as they had not appeared in Court despite a specific direction.

In response to the notices issued by this Court, both respondentsMr. Bhanwar Singh and Mr. Sher Singh have filed their reply-affidavits in which they have tendered their unconditional apologies. While Mr. Sher Singh in his affidavit has stated that he could not appear as his son Mr. Rohit was seriously unwell and was admitted in Sanjivini Hospital, Mr. Bhanwar Singh has stated that he could not appear as he had high grade fever. Both of them have enclosed prescription/treatment slips issued by their doctor/hospital.

Both Mr. Bhanwar Singh and Mr. Sher Singh state that they have accepted the order dated 23rd August, 2016 passed in CS(OS) 1859/2015 by virtue of which their suit was dismissed. They also state that they have paid the costs of Rs. 1,00,000/- imposed by the Coordinate Bench. Keeping in view the aforesaid the unconditional apologies tendered by Mr. Bhanwar Singh and Mr. Sher Singh are accepted and present contempt petition is closed. However, respondents are warned to be more careful in future.
