O R D E R

% 23.09.2016 The petitioner has preferred the present bail application under Section 439 Cr.P.C. in case FIR No.281/2015 under Section 364/ 365/ 302/ 120B/ 34 and 201 IPC registered at Police Station - G.T.B. Enclave. The submission of the petitioner is that his wife has gall stone and she has to undergo an operation. He, therefore, seeks interim bail for a period of two months.

The status report has been filed, which shows that the petitioner has two sisters, aged 30 years and 24 years. The younger sister is working in UP Police. He has his wife, who is 26 years old and having gall bladder stone. She is under treatment at Lok Nayak Hospital. The petitioner has also his mother, who is 46 years of age and is a housewife, and his father is a taxi

driver. The medical papers of the applicant's wife have been got verified, which show that though she was advised surgery, she did not report on the date of admission.

Learned counsel for the petitioner, on an enquiry, states that no further date has been fixed for conduct of the surgery of the petitioner's wife.

The petitioner was arrested in this case after initiating proceedings under Section 82 Cr.P.C. Thus, there is grave apprehension that he might abscond, if he is released on bail. The charges against the petitioner are grave. Though the charge-sheet stands filed, the charge has not been framed as yet.

In these circumstances, I am not inclined to release the petitioner on bail at this stage.

Dismissed.
