1. None appears for the Respondent nor is there a counter affidavit filed.

2. The refund pertains to the AY 2012-13 and as pointed out by learned counsel for the Petitioner, the assessment is already time barred.

3. In that view of the matter, it is directed that within four weeks from today, the necessary refund order will be passed by the Revenue and within a week thereafter, the refund amount together with interest, if any, accrued on the refund amount will be paid directly to the account of the Petitioner.

4. In case if there is any grievance or non-compliance with the above order, W.P.(C) 3497/2017 Page 1 of 2.

the Petitioner is at liberty to seek appropriate remedy in accordance with law.
