% 05.09.2016 This petition seeks execution of the award dated 24.02.2010 passed in I.D. No. 70/06 by the Labour Court No. XVI, Karkardooma Courts, Delhi, by which the petitioner was directed to be paid an amount of Rs. 3 lakhs. The learned counsel for the petitioner states that the said amount has not been paid till date. He further submits that a cheque, issued by respondent no.3/ management of M/s Ogaon Publication Pvt. Ltd., could not be deposited for encashment because it was received after the due date. A communication was issued thereafter from the office of the Deputy Labour Commissioner, respondent no.2, which read as under: ''...... This is with reference to the recovery certificate issued by this office letter dated 20/03/2012 and to which cheque amounting to Rs. 3,00,000/- (Three Lacs) in favour of the workman Sh. Guddu was issued and was sent to the office for further necessary action at our end.
But it would be worth to mentioned that the cheque issued was received in this office on 15/10/2012, after a lapse of two and half month from the date of issuance of the cheque and because of the workman was also out of station, adding that period, he was not able to receive the same on time and the limitation of validity period was over.
You are therefore, requested to revalidate the same and sent to this office at the earliest....."
The petitioner seeks direction to the respondents to have the award executed by respondent no.3.
Mr. Anuj Aggarwal, the learned counsel for respondent nos. 1 & 2, who appears on service of advance copy, submits that requisite steps will be taken.
In these circumstances, the respondent is directed to take appropriate action within a period of six weeks from today. The petition is disposed off in the above terms. NAJMI WAZIRI, J SEPTEMBER 05, 2016/kk
