O R D E R

The learned counsel for the petitioner states that arbitral tribunal has been constituted pursuant to the orders passed by a Coordinate Bench today in ARB.P. 221/2016.

In the circumstances, it is directed that the present petition be considered as an application under Section 17 of the Arbitration and Conciliation Act, 1996. The order passed on 26.04.2017 shall continue till further orders are passed by the arbitral tribunal. It is clarified that the respondent is also at liberty to approach the arbitral tribunal for vacation/modification of the order dated 26.04.2017. It is also clarified that nothing stated in the orders passed by this Court shall be construed as an expression of opinion on the merits of the disputes. 3.
The petitioner would be at liberty to approach the arbitral tribunal for
urgent hearing after filing the record of the present petition (albeit, as an application under Section 17 of the Act) with the arbitral tribunal. 4.
The petition is disposed of.
