CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 27.04.2017 Vide judgment dated 23rd February, 2017 passed in W.P. (C) No.3231/2016 titled as Rambha College of Education Vs. National Council for Teacher Education & Anr., a learned Single Judge of this Court directed the Appellate Authority of respondent no.1 to consider the appeal of petitioner afresh by taking into consideration the NOC of the affiliating body issued on 26th October, 2015, for the academic session 2017-18. Petitioner's counsel had pointed out to the Court that the last date for granting the approval was 3rd March, 2017, accordingly, petitioner was given liberty to make a request for considering the appeal before 3rd March, 2017. Learned counsel for petitioner submits that petitioner was heard on 22nd March, 2017,

however, no order has been passed as yet. It is further submitted that last date for granting approval has been extended to 2nd May, 2017 from 31st March, 2017. Appellate Authority is directed to comply the order dated 23rd February, 2017 expeditiously and much before the extended last date so as to see that another academic session of petitioner is not wasted. Learned counsel for the petitioner has further pointed out that, in the order dated 23rd February, 2017, date of NOC has been wrongly mentioned as 26th October, 2015 instead of 8th January, 2016. It is submitted that NOC dated 8th January, 2016, was annexed as Annexure P-10 with W.P.(C) No.3231/2016. It is further submitted that NOC dated 8th January, 2016 has already been submitted to Appellate Authority. Learned counsel for the respondents submits that appeal of petitioner has already been heard on 22nd March, 2017 and order, if not passed, will be passed and if already passed, will be uploaded before 2nd May, 2017. Ordered accordingly.

Writ petition is disposed of.
