O R D E R

% 15.10.2018 I.A. 12996/2018 Though the present application has been filed under Order 23 Rule 3 read with Section 89 CPC, yet the application is difficult to comprehend. Plaintiff, who appears in person, prays that he be allowed to unconditionally withdraw the present suit.

Learned counsel for the defendants has no objection to unconditional withdrawal of the present suit.

Consequently, present suit is dismissed as unconditionally withdrawn. Since issues have not been framed in the present case, Registry is directed to issue to the plaintiff a certificate authorizing him to receive back from the Collector the full amount of the Court fee paid by him in the present suit.
