IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 8458/2018 & CM.APPL. 32523/2018 HARI SHANKAR JAIN ..... Petitioner Through:
Mr. Barun Sinha and Mr. Jivesh kR.
Tiwari, Advocates versus GOVERNMENT OF ANDHRA PRADESH AND ANR.
..... Respondents Through:
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 14.08.2018 1.
The petitioner has filed the present petition challenging the action of the Government of Andhra Pradesh in organizing an event with Shalom Christian Assembly - "Children Programme on the Teachings of Jesus Christ (In Telgu)" - which was organized on 11.08.2018 at Dr. B. R. Ambedkar Auditorium, 1, Ashoka Road, New Delhi 110001. 2.
It is the petitioner's case that the action of Government of Andhra Pradesh in organizing the said event is unconstitutional and militates against the secular structure of the Constitution of India. 3.
This Court is not inclined to entertain the present petition principally for two reasons. First of all, the event in question is already over and if the petitioner is aggrieved by any policy of the State Government of Andhra
Pradesh, it would be apposite for the petitioner to approach the courts in that State. Secondly, the present petition appears in the nature of PIL as the petitioner has not disclosed any special private right; however, the petition is not structured as a PIL.
4.
In view of the above, the present petition is disposed of leaving it open for the petitioner to take recourse to other remedies as available in law. 5.
The pending application is also disposed of.
