Learned counsel for the appellant states that a Contempt Appeal (C) would not lie against the impugned order and thus the appeal may be permitted to be withdrawn observing that the intra Court appeal remedy availed of by the appellant in the form of a Letter Patent Appeal would be decided as per law.

The appeal is dismissed as withdrawn observing that the LPA filed by the appellant against the impugned decision shall be decided by the Roster Bench as per law including objection by the respondents concerning maintainability of the LPA itself.

No costs.
