% 25.04.2017 Crl.M.A. 6709/2017 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 732/2017 The present application has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in FIR No.226/2015, under Sections 498-A/304B/34/109 IPC, Police Station Uttam Nagar. Admittedly, no order of cognizance has been passed by the Court of Session.

The petitioner had moved an application before the Court of Session where the application has been disposed of mentioning therein that the charge sheet has already been filed against the accused without arrest. It is apparent from the record that no order taking cognizance has been passed by the court nor summon or

warrant has been issued against the accused. In the absence of the same, this Court does not find any ground in the instant application. Consequently, the present application is dismissed. However, the petitioner would be at the liberty to move fresh application as and when need arises.
