O R D E R

% 14.03.2016 After some arguments, it has been agreed that the present suit i.e. suit No. 04/2013 titled as "Sanjay Sharma Vs. K. K. Vaid" which is a suit for mandatory and permanent injunction to be clubbed along with the second suit which has been filed by Sanjay Sharma against K.K.Vaid and Inderpal Singh which is a suit for possession and cancellation of documents i.e. suit no. 345/2006 pending before learned Additional District Judge, West (Ms. Deepali Sharma). The present suit is pending before Ms. Savita Rao, learned Additional District Judge, District West.

In view of the aforenoted position, the suit having been clubbed with the second suit which is a suit for possession and cancellation of

documents will be transferred to the Court of Ms. Savita Rao, learned Additional District Judge, District West where the first suit which is a suit for mandaroy and permanent injunction is stated to be pending. Parties to appear before learned District & Sessions Judge, Tis Hazari, Delhi on 05.04.2016 who will pass appropriate orders of transfer.

Needless to state that since both the suits are clubbed together the defence taken by the petitioner (Inderpal Singh) in the second suit i.e. in the suit for possession and cancellation of documents will be considered by the Court at the time of passing judgement in the present suit.

Interim order stands vacated.

Petition disposed of.
