After some arguments, it appears at the threshold that the order passed by this Court on 09.05.2006 in W.P.(C) 5546/2004 and W.P.(C) 2618/2000 has not been complied with.

It is also seen that the respondents had not filed any counter affidavit

to the aforesaid petition and orders by this Court were reserved. However, after the orders were reserved, this Court considered it apposite to seek certain clarifications in respect of joint inspection, as was directed by the order dated 09.05.2006 and, accordingly, these petitions were re-listed. 3.

This court is informed that the joint inspection as directed was not conducted.

It also appears from the record that despite orders that the respondents shall convert the properties in question without alluding to the question of encroachment or sub-letting, the same was not done. 5.

In view of the above, the Managing Director of DSIIDC is directed to be present in Court for the assistance of this Court. This Court shall also consider whether any proceedings for contempt are required to be initiated. 6.
