By this petition the petitioner seeks interim bail in case FIR No.142/2017 under Sections 366A/376D/328/365/34 IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 (in short 'POCSO Act') on the ground that his wife has delivered a child and there is no one to look after the child and his wife.

On a notice being issued a status report has been filed. Learned APP for the State on instructions submits that the investigation is complete and the charge sheet will be filed tomorrow before the learned Trial Court. 3.
Without adverting to the allegations in the FIR against the petitioner, considering the fact that the wife of the petitioner has delivered a baby and there is no one to look after her, rather there is one more child aged one year nine months old, who has also to be looked after, this Court deems it fit to BAIL APPLN. 721/2017
grant interim bail to the petitioner.

It is therefore, directed that the petitioner be released on interim bail for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹50,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM/Jail Superintendant, further subject to the condition that during the period of interim bail the petitioner will not enter the lane in which the prosecutrix and her family members are residing and in no way come in contact with the witnesses of the prosecution.
