BAIL APPLN. 737/2017 Poonam @ Pinki was married on 22.05.2016 with Ashwani Kumar son of Sh. Surya Narayan. She died on 28.01.2017 in hospital. The preliminary assessment of the cause of death indicates that she was deprived of food and water. The cause of death is yet to be finally determined. FIR No.49/17 has been registered by PS Anand Parbat at the instance of her father Ram Kishore, he having lodged a complaint dated 28 .01.2017, the FIR having been registered on 29.01.2017 for investigation into offences, inter alia, under BAIL APPLN. 737/2017
Sections 498A, 406, 304B, 34 IPC. Though the name of the applicant Dev Narain son of Sh. Ram Chandra appears in the said complaint forming the basis of the FIR, there are no direct allegations of any act of commission or omission made against him.
In the facts and circumstances, the application is allowed. It is directed that in the event of he being arrested, during the investigation into FIR No.49/2017, under Sections 498A, 406, 304B, 34 IPC, Police Station Anand Parbat, the applicant shall be released on bail on he furnishing a personal bond in the sum of Rs.30,000/- with one surety in the like amount to the satisfaction of the arresting officer subject to the condition that he would cooperate with the investigation as and when called upon to do so and shall not temper with or come in contact with any of the witnesses of the complainant. It is made clear that this order will inure to the benefit of the applicant only till the date of first appearance before the court of cognizance in the event of a charge-sheet being submitted seeking his prosecution and cognizance being taken thereupon.
