% 30.11.2015 After some hearing, learned counsel submitted that the liberty to urge the contentions with respect to the maintainability of the amended suit and the altered reliefs should be expressly reserved; subject to which, the appeal would not be pressed. It is clarified that the appellant/defendant is at liberty to rely on all such pleas, including limited to the question of fresh or amended reliefs to be time barred in accordance with law. The appeal is accordingly dismissed as not pressed in the above terms.
