IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 2523/2018 & CRL.M.A. 6107/2019 AKANSHA FAUZDAR ..... Petitioner Through:

counsel for the petitioner (appearance not given).

versus UNION OF INDIA AND OTHERS ..... Respondents Through:

Ms Kamna Vohra, ASC for State.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 27.09.2019 1.

The petitioner has filed the present petition, inter alia, praying that directions be issued to respondent no.3 to transfer FIR No.0411, registered with PS Saket, to either the Crime Branch or to investigate the same with a competent IO.

2.

The petitioner had filed the aforesaid FIR under Section 498A/406/34 of the IPC. Thereafter, two other offences under Sections 377 and 354 of the IPC have also been added.

The principal controversy relates to the verification of the allegation of demanding and accepting dowry alleged to have been given by the petitioner's family at the time of marriage and thereafter.

3.

The status report had been filed, which indicates that the material provided by the petitioner has been examined. This Court is refraining from commenting on the same; however, it is apparent that the allegations made

by the petitioner are being investigated. The petitioner is also at liberty to provide any further information to the IO and needless to state that the IO shall examine the same.

4.

This court is unable to accept that there is any deficiency in the investigation at this stage.

5.

The petition is, accordingly, disposed of leaving it open for the petitioner to urge all contentions before the concerned court at the stage of framing of charges/closure.

6.

The pending application is also disposed of.
