The learned counsel appearing for the respondent points out that by an order dated 01.09.2017 passed by the National Company Law Tribunal (NCLT), an Interim Resolution Professional has been appointed and, therefore, no proceedings can be instituted or continued against the respondent without permission from NCLT.
