% 03.11.2017 Learned counsel for the petitioner submits that matter has been compromised with the respondent no. 2; therefore, FIR No. 489/2015 under Sections 379/356 IPC registered at Police Station Pandav Nagar on 21st July, 2015, on the complaint of respondent no. 2, may be quashed. Respondent no. 2 is the Manager of Maa Anand Mai Service Station. A perusal of the FIR shows that on 2nd July, 2015 a Swift Dzire car bearing registration no. DL2CAT8233 came at the petrol pump for filling the petrol at about 4:40 pm. Petrol of `1000/- was filled. Car driver fled away without making the
payment. At about 2:15 pm, one motorcycle rider came there and asked for the change of `100/-. Thereafter, he snatched `7,000/- from the Salesman, namely, Sachin Kumar.
During the investigation, it was revealed that petitioner was the owner of said car.
Investigations are still in progress.
Motorcycle rider has yet to be traced out.
Keeping in mind the nature of offence, I am not inclined to quash the FIR, even though compromise has taken place between the petitioner (accused) and complainant.
Petition is dismissed.
