% 13.09.2025 Appellant insurance company has filed an appeal for reduction of the award dated 12.09.2014 passed by the Learned MACT, awarding a compensation of Rs. 10,21,295/- along with interest @ 7.5% p.a. from the date of filing of claim petition. On appeal, the insurance company deposited entire awarded principal amount along with accrued interest before the Registrar General of this Hon'ble High Court in terms of the order dated 17.11.2014 passed by this Hon'ble Court and 40% of the awarded amount along with accrued interest was also released to respondent/claimant.
We have interacted with the learned counsel/parties concerned. Apropos such interaction and deliberation, out of the entire deposited amount along with accrued interest, lump sum amount of Rs. 1,20,000/- be refunded to the Appellant insurance company and balance amount lying deposited before the Ld. Registrar General of the Hon'ble High Court along with the total interest be released to the Respondent No. 1.
In terms thereof, Ld. Registrar General is directed to refund a sum of Rs. 1,20,000/- to the Appellant Insurance Company and release the balance amount lying deposited before the Ld. Registrar General along with total interest to the Respondent No. 1 in terms of the award of the Tribunal.
Needless to say that appellant shall be entitled to refund of statutory amount along with interest, if any. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of with directions in terms of the settlement.
A copy of this order be sent to the concerned learned Tribunal with TCR, if already received.
