% 04.09.2018 It is the petitioner's case that his mother is afflicted with carcinoma genesis ailment and has undergone treatment for the same before the Delhi State Cancer Institute as well as the Govind Ballabh Pant Hospital and Institute. She refers to documents attached to the petition. However, none of the documents clearly show that she is suffering from cancer. The Status Report too does not confirm the same. The petitioner is involved in 63 serious crimes, successively over a period of 20 years from 1998 onwards; he is stated to be a habitual criminal and is likely to jump bail, if so released. Furthermore, the petitioner has his wife and a 24 year old sister as well as his able-bodied brother, who can take care of his mother. No grounds are made out for grant of interim bail.

At this stage, the learned counsel for the petitioner seeks custody bail for two days.

The petitioner is granted custody bail for two days, i.e., on 6th and 7th September, 2018 from 10.00 am to 6.00 pm, on each day. Should the condition of his mother deteriorate further, it will be open to him to move an appropriate application at a subsequent stage. The application stands disposed-off.
