The applicant is brother-in-law (nandoi) of the first informant (Heena). The offences alleged by her include those punishable under Sections 323/341/354/498-A/509/34 IPC. The MLC which has been collected by the investigating officer during investigation indicates the injuries suffered by the first informant to be simple caused by sharp edged weapon. On being asked, the learned Additional Public Prosecutor clarified that according to the further statement of Heena, the said injury was suffered upon she being pushed against a wall by the husband. 2.

Though there have been complaints lodged by the first informant on earlier occasions, having regard to the general nature of such complaints and the fact that the averments concerning the offences punishable under Sections 354/498-A IPC, generally concern the husband and other members of the family, the applications are allowed.

It is directed that in the event of the applicant being arrested in case FIR No.86/2017, under Sections 323/341/354/498-A/509/34 IPC of police station Sagar Pur, he shall be released on bail, on he furnishing personal bond in the sum of Rs.20,000/- with one surety in the like amount to the satisfaction of the arresting officer, subject to the condition that he shall join the investigation as and when called upon to do so and shall not tamper or influence any of the witnesses.
