% 28.09.2018 By this petition, the petitioner seeks anticipatory bail in case FIR No.493/2016 under Section 420/406/34 IPC registered at PS Madhu Vihar. Abovenoted FIR was registered on the complaint of Vidhur Bhardwaj who stated that he came into contact with petitioner and his wife Rekha through a common friend. In the month of March, 2014, the petitioner and his wife approached the complainant for selling the two Innova cars which complainant alleged to purchase for a sum of ₹15,80,000/-. The complainant gave money and signed the documents. Petitioner and Rekha also signed the receipt of the sum of ₹15,80,000/- however the petitioner and his wife on the pretext that they need to use the two vehicles for a function, BAIL APPLN. 1915/2018

they took back the vehicles and did not return the same. Later the petitioner and his wife also issued two cheques for a sum of ₹8 lakhs and ₹7.5 lakhs stating that they would like to retain the cars, however, the two cheques bounced. During the course of investigation, original receipt of ₹15,80,000/- has already been given to the investigating agency. As per the petitioner one of the car got lost in the calamity in Kedarnath however nothing is stated about the second Innova car.

Considering the facts noted above, this Court finds no ground to grant anticipatory bail to the petitioner.

Petition is dismissed.
