The petitioner has filed the present petition, inter alia, praying as under:- "It is therefore most respectfully and most humbly prayed that this Hon'ble court be pleased to issue a writ of mandamus or any other writ or order or directions for quashing and setting aside impugned order dated 30.10.2017 of respondent No.3 whereby respondent No.3 has illegally and malafidely placed the name of the petitioner under "prior approval category" and has also imposed a ban of five years on issuing fresh passport to the petitioner till 17.07.2022 in the most illegal and arbitrary manner and in gross violation of the provisions of the Passport Act and in gross violation of the fundamental rights of the petitioner and further direct the respondents to immediately
issue a fresh passport to the petitioner on his application dated 18.08.2017 vide file No.JAL070554171816/POJ/MRG." 3.
Mr Mohan, learned counsel appearing for the respondents states, on instructions, that if the petitioner files applies for a passport afresh, the same would be considered in the light of the Office Memorandum dated 25.07.2018 and the fact that the petitioner had been deported from United States of America, would not stand in the way of his application being processed.
