IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4133/2018 KRISHANA & ANR ..... Petitioners Through:

Mr. Vinod Kumar Sharma, Adv.

versus THE STATE ( NCT OF DELHI) & ORS ..... Respondents Through:

Dr. M.P. Singh, APP for State with ASI Rajbir Singh, P.S. Bawana.

Respondent nos. 2 and 3 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 16.08.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent nos. 2 and 3 are present in Court and accept notice. They have been identified by ASI Rajbir Singh of police station Bawana. Respondent nos.2 and 3 submit that they have settled the matter with petitioners of their own free will and without any undue force, pressure or coercion. In view of the settlement, they do not wish to pursue the FIR No. 183/2017 under Sections 323/341/452/34 IPC registered at police station Bawana any further and have no objection in case the same is quashed. Affidavits of respondent nos. 2 and 3 to this effect are also on record. Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would

be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.

A.K. PATHAK, J.
