O R D E R

% 27.10.2017 It is submitted that disputes between the petitioner and respondent no.2 have been settled vide Memorandum of understanding dated 28th January, 2014.

Petitioner has already paid `25 lakh to complainantrespondent no.2 in terms of the settlement. Respondent no.2 is present in Court along with his counsel and admits the factum of settlement. He says that he has settled the matter with the petitioner of his own free will, voluntarily and without any undue force, pressure or coercion and he is not willing to pursue the criminal proceedings against the petitioner any further, therefore, FIR 175/2009 under Sections 406/420/467/468/471/120B IPC registered at PS EOW (South District) may be quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 vide Memorandum of understanding dated 28th January, 2014, in the interest of justice FIR 175/2009 under Sections 406/420/467/468/471/120B IPC registered at PS EOW (South District) and

the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
