% 14.01.2016 Arguments heard.

The present application under Section 438 Cr.P.C. has been filed by the petitioner for the grant of anticipatory bail in FIR No.558/2014, under Section 394/34 IPC, Police Station Jaitpur. Status report has been filed.

As per the status report, the petitioner/accused has already joined the investigation on 30.04.2015, 01.05.2015, 03.05.2015, 22.09.2015, 05.10.2015, 22.10.2015, 01.11.2015 and 16.11.2015. It appears that the petitioner/accused is not required for the purpose of arrest.

During the course of arguments, on the instructions of the

Investigating Officer, learned Additional Public Prosecutor for the State has submitted that no conclusion is drawn by the Investigating Officer with regard to requirement of the arrest of the petitioner/ accused in the present case.

In the facts and circumstances, the application is allowed. It is hereby ordered that in the event of arrest of the petitioner/accused, he shall be released on furnishing the personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the arresting officer.

The petitioner is directed to join the investigation as and when required.

He shall not tamper with the evidence or influence the prosecution witnesses. He is also directed not to leave the country without prior permission of the concerned Court.
