% 25.04.2017 CRL.M.A. 6757/2017 Exemption allowed subject to all just exceptions. Application stands disposed of.

W.P.(CRL) 1197/2017 The petitioner seeks parole for preferring SLP against the judgment and order of conviction of the Trial Court which was sustained by the High Court. Mr.Ashish Aggarwal, learned Additional Standing Counsel submits that instead of preferring the petition for release on parole before the Jail Superintendent, the petition was filed before the Home Secretary. Now the petition has been sent to the Superintendent of the concerned jail from where it has been referred to the competent authority for taking a decision.

Mr.Ashish Aggarwal submits that a decision in this regard shall be taken within a period of two weeks.

On this statement of Mr.Aggarwal, Mr.Dhan Mohan seeks permission to withdraw this petition. In case no decision is taken within two weeks, he shall be at liberty to file a fresh petition seeking parole. Dismissed as withdrawn with the liberty as aforesaid. ASHUTOSH KUMAR, J APRIL 25, 2017 k
