% 21.02.2019 By this petition, the petitioners seek quashing of FIR No. 300/2018 under Sections 356/379/511/323/34 IPC registered at PS Begumpur, Delhi on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. Learned Additional Standing Counsel for the State on instructions submits that in the above noted FIR the three petitioners are the only accused and the respondent No.2 is the complainant/ victim and respondent No. 3 the other victim.

Respondent Nos.2 and 3 who are present in Court and are identified by the learned counsel and Investigating Officer states that on 30th May, 2018 at around 8-9 P:M while they were at the red light of Begumpur, the three petitioners came on a scooty and stopped at the red light. Since the scooty was too close to the car where the respondent No. 2 was sitting, she apprehended that the petitioners were attempting to snatch the chain and thus lodged the above noted FIR in confusion. A quarrel ensued between them and both sides slapped each other. She states that since the above noted FIR was lodged in confusion and now, she and her husband i.e. respondent No. 3 have settled the matter with the petitioners who are the students, she does not wish to pursue the abovementioned FIR and the proceedings pursuant thereto.

Petitioners who are present in Court and are identified by the learned counsel affirm the statement of respondent Nos.2 and 3 and assure that they will be careful in future and no such misbehaviour will take place in future with any one.

In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No. 300/2018 under Sections 356/379/511/323/34 IPC registered at PS Begumpur, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
