O R D E R

% 28.01.2019 This petition challenges the order dated 10th May, 2018 in eviction petition No.5948/2016 whereby the eviction order was passed in favour of the respondent and against the petitioner. After some arguments learned counsel for the petitioner submits that he shall be satisfied if the petitioner is given six months' time to vacate the subject premises and he do not intend to challenge the impugned order on merits. Learned counsel for the respondent has no objection to the same.

In the circumstances, the petition stands disposed of on an undertaking given by the counsel for the petitioner, on instructions, that the petitioner shall vacate the premises on or before 31st July, 2019 and shall handover its peaceful possession to the respondent

subject to furnishing the undertaking within four weeks from today. The user and occupation charges shall be paid by the petitioner as per agreed rate (contractual rental) between the parties. The water and electricity charges be paid as per actuals. Any default of the above order would entail eviction forthwith.

Pending applications also stand disposed of.
