The petitioner is seeking enlargement on interim bail on the ground he requires to be present at the side of his wife who is to undergo surgical procedure for removal of uterus in Amritsar, his native place. The petitioner is facing trial in criminal case arising out of FIR No.50/2015 on the charge of offence punishable under Section 18 and 29 of the Narcotics and Psychotropic Substances Act, 1985 (NDPS Act), the allegations indicating he having been found in possession of commercial quantity of contraband substance.

His co-accused is at large avoiding appearance leading to proclamation under Section 82 Cr.P.C. having been initiated. BAIL APPLN. 801/2017

Keeping in view the provisions contained in Section 37 of the NDPS Act, 1985 and having regard to the circumstances set out, the State pointing out that the wife of the petitioner has requisite support of the family and that it includes the father and brother of the petitioner, no good ground for release on interim bail are made out.

Dismissed.
