He states that he has taken instructions and seeks liberty to withdraw the suit vis-à-vis defendant no. 4.

Learned counsel for the defendant no. 4 has drawn this Court's attention to the order dated 23.08.2017, which opined that prima facie, no case of passing off or infringement has been made out against defendant no. 4.

In view of the aforesaid order dated 23.08.2017 and the statement of plaintiff, the suit is dismissed as withdrawn vis-à-vis defendant no. 4 without any liberty reserved to the plaintiff.

Pending applications, if any, stand disposed of. 6.

Future dates stand cancelled.
