This petition under Article 227 of the Constitution of India impugns the observations against the petitioner, an advocate in para 13 of the judgment dated 6th March, 2017 of the Court of Additional Senior Civil Judge (ASCJ), New Delhi District, Patiala House Courts, New Delhi in CS No.56835/2016 (Old No.259/2013) filed by M/s New India Publications against the respondent Railway Board.

The petitioner was the advocate for the Railway Board before the Suit Court.

The learned ASCJ in para 13 of the judgment has commented on the conduct by the petitioner, appearing as advocate of the respondent Railway Board, and imposed costs on the respondent Railway Board for the conduct of its advocate.

The counsel for the petitioner states that the petitioner has been an advocate for the respondent Railway Board for two years, though otherwise has 18 years of professional experience and will suffer professional prejudice unless the said observations against the petitioner are quashed. 7.

Though no error can be found in the observations made by the ASCJ and the ASCJ was fully justified in making the said observations but on the assurance of the petitioner personally present in the Court that he will in future conduct cases on behalf of the respondent Railway Board as well as on behalf of his other clients professionally after studying the law and putting his best efforts and which assurance I have no reason to disbelieve, it is deemed appropriate to grant an opportunity to the petitioner to save his career.

Para 13 of the judgment dated 6th March, 2017 is accordingly quashed and be not read as part of the judgment.

Copy of this order be given dasti under the signatures of the Court Master.
