This proceeding initially filed as a First Appeal against Order and registered as FAO No.43/2017 and ordered on 18th April, 2017 to be converted into a Civil Revision Petition impugns the order (dated 6th September, 2016 in CS No.7187/2016 of the Court of Additional District Judge-06 (South-East), Saket Courts, New Delhi) of dismissal of the application filed by the petitioner/defendant under Order VII Rule 11 of the Code of Civil Procedure, 1908.

Notice of the petition was issued and the counsel for the respondent/plaintiff appears.

After substantial arguments, the counsel for the petitioner/defendant withdraws the petition.
