O R D E R

% 01.05.2017 The petitioner was granted parole by the competent authority on 22.03.2017 for a period of four weeks for attending to his mother who had to be operated upon.

The period of parole expired on 29.04.2017.

In the meantime, the date of the operation was extended and the petitioner made an application for extension of the aforesaid parole. On the expiry of the period of parole the petitioner has surrendered.

As such, this application for extension has become infructuous. Learned counsel for the State submits that the application for extension before the competent authority is pending and a decision on such application shall be taken in a short while.

Considering the aforesaid submission of the counsel for the State, Mr. Dhan Mohan, learned counsel for the appellant, seeks permission to

withdraw this application in order to enable him to file a fresh application in case it is needed at an appropriate stage.

Dismissed as withdrawn.
