% 11.08.2016 In this appeal, vacation of the stay order is sought by the appellantdefendant. As per order of 7th September, 2015, talks for an out of court settlement were underway between the parties. It is now informed that the said settlement talks are at the advanced stage. Both sides submit on instructions that this appeal can be disposed of with permission to get this appeal revived in case settlement talks fail. In view of the stands taken as aforesaid, this appeal and the pending application are disposed of as not pressed, with liberty to revive them if need be.
