O R D E R

% 18.05.2017 1.

The petitioner is seeking modification of the order dated 9th June, 2016 passed by the Family Court on the second motion for divorce by mutual consent to the extent that the petitioner be granted four full day meetings per month instead of one meeting recorded therein. 2.

Learned counsel for the petitioner submits that the petitioner approached this Court as there was no Presiding Officer in the Principal Family Court, South East District, Saket.

Since the Presiding Officer of the Principal Family Court, South East District Saket has now been appointed, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file an appropriate application before the Family Court.

Learned counsel for the petitioner further submits that he shall file the application before the Family Court for being listed on 31st May, 2017 and the respondent be directed to appear before the Family Court on 31st May, 2017 to which learned counsel for the respondent has no objection.

The petition and the application are dismissed as withdrawn with

liberty as prayed for.

Both the parties present in Court agree to make an endeavour to resolve their dispute through mediation.

List before Delhi High Court Mediation and Conciliation Centre on 19th May, 2017 at 4.00 pm.

The Delhi High Court Mediation and Conciliation Centre shall send the report directly to the Family Court, South East District, Saket. 8.

The Trial Court record be returned back forthwith. 9.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
