O R D E R

% 23.02.2018 Vide the present petition the petitioner/institute prays for quashing of order dated 09.08.2016 passed by respondent No.1 as also the minutes of meeting dated 4/6.02.2016 held by respondent No.2 in respect of the petitioner. Learned counsel for the petitioner submits that petitioner's case was rejected on the ground that the NOC from affiliating body had been submitted to the respondent after the cut-off date provided in the regulation. He submits that this issue is no longer res integra and has already been settled by various decisions of this court. The learned counsel for the respondent is unable to dispute the aforesaid position and concede that the decisions of this court in similar matters has attained finality as the SLP filed by the respondents already stand rejected.

In view of this, the writ petition is allowed. The order dated 09.08.2016 passed by the respondent No.1 and the minutes of meeting

04/06.02.2018 of respondent No.2 in respect of the petitioner/institute are quashed. The respondents are directed to consider the application of the petitioner expeditiously by taking into consideration the NOC supplied by him on 09.07.2015 and keeping in view the cut-off date for recognition is 03.03.2018. The respondents are directed to consider the application of the plaintiff as expeditiously as possible subject to the meeting all criteria on or before 03.03.2018.
