O R D E R

% 01.05.2015 Petitioner is in incarceration for more than 10 years. He seeks parole on the ground that he wants to meet his mother who is suffering from heart ailments. According to petitioner his mother had suffered heart attack 12-13 years ago therefore he cannot produce medical documents. He claims that his mother is about 60 years of age; while his father is 70 years of age. Additional Standing Counsel submits that petitioner has not annexed any medical document regarding treatment being provided to his mother. It may be noted that petitioner is in incarceration for more than 10 years. He has categorically mentioned in the petition that the documents regarding ailments of his mother are not available as she had suffered heart attack 12-13 years ago. Be that as it may, a convict, in long incarceration, is entitled to parole

once a year in order to maintain social ties and to blend himself in the mainstream of society. In this case, petitioner was released on parole for four weeks pursuant to the orders of High Court in the month of May, 2014. This fact is evident from a perusal of nominal roll. On earlier occasion, petitioner had surrendered before the Jail Superintendent 2nd June, 2014 after availing the parole.

Keeping in mind the totality of circumstances, petitioner is directed to be released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the Jail Superintendent. Petitioner shall not leave the territorial bounds of Delhi. During the parole period, petitioner shall report to the Station House Officer of the concerned Police Station once a week, i.e., on Mondays at 10:00 am. On completion of parole period, petitioner shall surrender before the Superintendent Jail. Writ petition is disposed of in the above terms. Copy of the order be sent to the Jail Superintendent for serving it upon the petitioner and for compliance.
