% 08.02.2016 Learned counsel for the plaintiff submits that he has instructions from the plaintiff to withdraw the present suit. Hence, seeks permission to withdraw the present suit, statement of counsel for the plaintiff recorded separately.

By virtue of provision under Rule 3 Sub Rule 13 of Delhi High Court (Original Side) Rules 1967. Learned counsel for the plaintiff is permitted to withdraw the present suit. Accordingly, suit is dismissed as withdrawn. Since the suit is withdrawn at initial stage. Court fees be returned to the plaintiff as per rules.
