W.P.(C) 4357/2017 & CM Nos. 19004/2017 The present petition has been filed by the petitioner with the following prayers:

" In view of the aforesaid facts and circumstances of the case and in the interest of justice this Hon'ble Court may graciously be pleased to:- (a) Pass an appropriate writ, order or direction thereby quashing and setting aside the infructuous order F.DE45/VE/2014/011 dated 05/01/2016 and show cause notice No.F.DE-45/VE/2014/1017 dated 10/06/2015;

(b) Pass an appropriate writ, order or direction thereby directing the respondent No.1 to revoke the impugned

termination order and allow the petitioner to avail all possible future career and right to life;

(c) Pass such other (s) or direction (s) as this Hon'ble Court may deem fit and proper in the interest of justice." It is a conceded position that the petitioner was appointed on contract basis as a vocational teacher to teach vocational course of Food Production, Food and Beverage Services in the School namely President Estate, SV (Dr. Rajendra Prasad) School, which is a School run by the Directorate of Education. If that be so, the subject matter of the writ petition shall be within the jurisdiction of the Central Administrative Tribunal. At this stage, learned counsel appearing for the petitioner seeks to withdraw the petition with liberty to approach the Central Administration Tribunal.

With liberty as prayed for, the petition and the connected application are dismissed as withdrawn.
