After brief submission, the learned counsel for the appellant has very fairly stated that since the arbitration proceedings are underway, therefore he is not pressing his appeal, subject to his filing an application for grant of ad interim relief before the arbitrator. It has been further urged that a direction be given to the learned Arbitrator to decide the application for ad interim relief as expeditiously as possible. The learned counsel for the respondent does not have any objection.

Having regard to the submissions made by the learned counsel for the parties, the present appeal is dismissed as not pressed with liberty to the appellant to file an appropriate application for ad interim relief before the learned Arbitrator. It is expected that as and when such an application is filed by the appellant, the same shall be decided in accordance with law as expeditiously as possible.

With these observations the appeal stands disposed of. 4.

Copy of the order be given Dasti to the learned counsel for the parties. 5.
