Learned APP accepts notice for respondent no. 1.
Respondent no.2-Mr. Shivam Kumar Jha is present in Court along with his counsel and accepts notice. He has been identified by ASI Shyam Nandan of police station Uttam Nagar.
Respondent no.2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion, vide a Compromise Deed dated 23rd July, 2018. Respondent no. 2 says that he has no objection in case FIR no. 361/2018 under Sections 323/341/506/34 IPC registered at police station Uttam Nagar, which is at the
investigation stage, is quashed against the petitioners. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.
